三亚一男子虚构事实诈骗100余万元获刑16年
近日，三亚市中级人民法院作出判决，维持一审判决，以林某明犯诈骗罪，与原判犯诈骗罪并罚，决定执行有期徒刑16年，并处罚金30万元。王某一直想给女儿找个医院的工作。2017年5月，王某经人介绍认识林某明，对方自称认识三亚市某医院的领导，可以安排王某女儿进入三亚市某医院工作。见王某信以为真，林某明又谎称能为王某女儿申请三亚市公务员保障性住房、帮王某在三亚市海棠区办理社区卫生服务站等，进行诈骗。
2017年5月至2018年8月，林某明购买并使用伪造的任命通知书、国有土地使用证、房屋所有权证、医疗机构执业许可证等相关虚假文书、证件，多次骗取王某等人向其指定的银行账户、微信、支付宝等存款、转账，支付现金。其间，王某介绍严某找林某明帮其姐姐的孩子入职一家医院，林某明从中诈骗3万元。严某发现被诈骗后，林某明退还部分钱款，王某替其退还剩余的2.29万元给严某。经司法会计鉴定，王某被骗钱款数额共计103.52万余元。
据了解，林某明因犯诈骗罪，于2020年5月21日被法院判处有期徒刑7年3个月，并处罚金10万元，刑期自2019年8月5日起至2026年11月4日止。
一审法院经审理认为，林某明无视国家法律，以非法占有为目的，虚构事实多次骗取他人钱款共计103.52万余元，数额特别巨大，其行为已构成诈骗罪，应依法惩处。法院判决，林某明犯诈骗罪，判处有期徒刑11年6个月，并处罚金20万元；与原判犯诈骗罪，判处有期徒刑7年3个月并处罚金10万元并罚，决定执行有期徒刑16年，并处罚金30万元。
宣判后，林某明不服提起上诉。三亚市中级人民法院经审理认为，原审判决认定事实清楚，证据确实、充分，定罪准确，量刑适当，审判程序合法，依法应予维持，遂作出以上判决。
