海南自贸港个税优惠政策落实事项
个税优惠政策
对在海南自由贸易港工作并享受个人所得税优惠政策的高端紧缺人才实行清单管理，其个人所得税实际税负超过15%的部分予以免征。
政策依据：《海南省人民政府关于印发海南自由贸易港享受个人所得税优惠政策高端紧缺人才清单管理办法的通知》（琼府〔2025〕43 号，以下简称《清单管理办法》）
相关事项公告来源于海南自贸港的所得
来源于海南自由贸易港的所得，是指高端紧缺人才从海南自由贸易港取得的综合所得（包括工资薪金、劳务报酬、稿酬、特许权使用费四项所得）、经营所得以及经海南省认定的人才补贴性所得，相应税款在海南自由贸易港缴纳。其中：
工资薪金所得，是指个人因在海南自由贸易港任职、受雇，从该任职受雇单位取得的工资、薪金、奖金、年终加薪、劳动分红、津贴、补贴以及与任职、受雇有关的其他所得。
劳务报酬所得，是指个人因在海南自由贸易港从事劳务，从海南自由贸易港取得的所得。
稿酬所得，是指个人因其作品以图书、报刊等形式出版、发表，从海南自由贸易港取得的所得。
特许权使用费所得，是指个人因提供专利权、商标权、著作权、非专利技术以及其他特许权的使用权，从海南自由贸易港取得的所得。
经营所得，是指在海南自由贸易港从事生产、经营活动取得的所得。
海南省认定的人才补贴性所得，根据发放对象、发放方式分别确认。与任职、受雇有关的，计入综合所得；与从事生产、经营活动有关的，计入经营所得。
减免税额计算
高端紧缺人才按照以下方法计算海南自由贸易港个人所得税优惠政策减免税额：
（一）居民个人综合所得减免税额计算
减免税额=（综合所得应纳税额－综合所得应纳税所得额× 15%）×海南自由贸易港综合所得收入额÷综合所得收入额
（二）居民个人经营所得减免税额计算
减免税额=（经营所得应纳税额-经营所得应纳税所得额× 15%）×海南自由贸易港经营所得应纳税所得额÷经营所得应纳税所得额
（三）非居民个人相关所得减免税额计算
非居民个人工资、薪金所得减免税额=（工资、薪金所得应纳税额-工资、薪金所得应纳税所得额×15%）×海南自由贸易港工资、薪金所得收入额÷工资、薪金所得收入额
非居民个人劳务报酬、稿酬、特许权使用费所得减免税额=海南自由贸易港应纳税额-海南自由贸易港应纳税所得额×15%
非居民个人经营所得减免税额=（经营所得应纳税额-经营所得应纳税所得额×15%）×海南自由贸易港经营所得应纳税所得额÷经营所得应纳税所得额
累计居住满183天核算方法
享受海南自由贸易港个人所得税优惠政策的高端紧缺人才，一个纳税年度内（自公历1月1日至12月31日）应在海南自由贸易港累计居住天数满183天，合理的离岛出差、休假、学习培训天数可计入在海南自由贸易港居住天数，实际居住天数不得少于90天。进入和离开海南自由贸易港的当天，均按1天计算居住天数。一个纳税年度内有多次进出的，合并累计计算。
享惠资格认定程序
（一）相关人员名单汇总。根据享惠条件，省人才管理部门于每年1月31日前将上一年度经认定的高层次人才名单，推送至省人力资源社会保障部门；省税务部门于每年1月31日前将上一年度内来源于海南自由贸易港收入达到30万元人民币以上人员名单，推送至省人力资源社会保障部门。
对在海南自由贸易港内注册且主营业务收入占收入总额60%以上的航空航天、航运、海洋油气勘探等行业企业或单位的特定人员（以下简称特业人员），因职业特点一个纳税年度内在海南自由贸易港累计居住不满183天的，由本人通过任职受雇、生产经营企业或单位，于每年3月1日前在海南省电子税务局如实填报《海南自由贸易港特定行业人员享受个人所得税优惠申请表》。省税务部门汇总符合行业范围的申请人员信息后推送至省人力资源社会保障部门。
（二）享惠人员资格审核。省人力资源社会保障部门将相关人员名单推送至省营商环境、社会保险经办机构等部门，其中营商环境部门负责提供个人信用情况；社会保险经办机构负责提供特业人员社保缴纳情况；省人力资源社会保障部门负责汇总相关情况进行审核。审核结果将通过省人力资源社会保障厅、省税务局网站等官方渠道提供查询。
1.实际居住天数满183天的人员，以及因职业特点一个纳税年度内在海南自由贸易港累计居住不满183天的特业人员，由省人力资源社会保障部门审核确认后，将符合条件的人员名单移交省税务部门。
2.实际居住满90天但不满183天的人员，省人力资源社会保障、税务部门每年4月30日前以短信、自然人电子税务局等方式提醒，由本人于每年6月30日前通过海南政务服务网或海易办提交经任职受雇、生产经营企业或单位公示（不少于5个工作日）并确认的出差、休假、学习培训等情况的个人承诺书（模板见附件）及相关证明材料。合理的离岛出差、休假、学习培训需具备正当的理由和目的，完备的任职受雇、生产经营企业或单位审批程序，完整的进出岛记录等要件。省人力资源社会保障部门对个人承诺书及相关证明材料进行审核确认后，将符合条件的人员名单移交省税务部门。
（三）审核结果异议处理。对审核结果有异议的人员，可于本年度内通过省人力资源社会保障部门指定渠道提供相关补充材料，申请复核。省人力资源社会保障部门牵头组织复核，复核结果通过省人力资源社会保障厅、省税务局网站等官方渠道提供查询。
（四）提醒办理享惠申请。省税务部门依据省人力资源社会保障部门移交的人员名单，核实高端紧缺人才任职受雇、生产经营企业或单位实质性运营等情况后，以短信、自然人电子税务局等方式提醒高端紧缺人才办理享惠申请。
上述事项为《海南省财政厅等五部门关于落实海南自由贸易港个人所得税优惠政策有关事项的公告》【2025年第24号】发布内容，该公告自2025年1月1日起执行。
