海口一区长因拆迁问题引咎辞职,官员什么情况下该有此举?

5月1日，海南海口市有关部门通报了海口市秀英区拆除部分违建过程中引发事端的情况及初步处理结果，确认联防队员打人属实。对于这一事件的问责，除打人联防队员被拘留之外，中共海口市委5月1日决定，同意对此事负有领导责任的秀英区区长黄鸿儒引咎辞职。

目前在我国官员引咎辞职的例子并不多，2008年时任国家质检总局局长李长江因为“三鹿奶粉”事件而辞职。到底什么事情没有处理好官员应“主动辞职”？

联防队员在执法时殴打妇女儿童

日前，一段多名执法人员殴打妇女、儿童的视频在网络上发布后引发广泛关注。从视频中可以看到，多名身穿深色短袖制服、头戴帽子、面遮口罩，手持警棍、木板等的人员，先是击打多名坐在地上的妇女，随后又殴打一男孩。据了解，这段视频是4月30日在海口市秀英区琼华村拍摄的，当天秀英区多部门联合执法，对当地的违章建筑进行强制拆除。视频曝光之后引发舆论哗然，暴力执法的行为招致各方谴责。





据海南有关方面透露，视频中的打人者为秀英区聘用的联防队员，目前已被治安拘留，负有管理不力责任的联防队中队长已被撤职。

当地官方表示有不法分子阻挠执法

不过，海口市有关部门也通报称，近年来，秀英区琼华村部分村民私自将村庄规划范围外土地非法转卖给外来人员，在周边农用地上滥占滥建，问题比较突出。4月29日起，秀英区多部门联合进行强制拆除。4月30号，一些外来人员和不法分子在现场煽动部分群众，采用丢砸石砖、燃放鞭炮、发射烟花等过激行为阻挠执法，并造成多名执法人员受伤。警方已将多名涉嫌严重阻挠执法的人员依法带离。

另据记者初步了解，在这次海口市秀英区强制拆除琼华村违建过程中，有部分村民对违建的认定是否实事求是、实施强制拆除流程和方式是否依法依规、如何处理善后安置等方面有不同的看法和意见，目前海口市有关部门正对这一事件展开进一步的调查处理。

海口市对联防队员打人事件问责

事件发生后，海口市成立了联合调查组展开查处，确认了网络上两类视频的真实性，一是联防队员打人视频，其次是村民扔石块、放烟花、烧煤气罐等阻扰执法的视频。其它视频是否属实正在甄别。

对于联防队员打人一事，海口市委、市政府要求联合调查组迅速查清事实，依法严肃处理，严厉问责。同时支持媒体介入调查事情经过，让广大群众包括网民了解事情的前因后果。目前，海口市相关部门负责人已上门向被打群众道歉，并安排受伤人员到医院治疗。海口市委市政府称，无论是执法，还是其他任何时候，都不能对手无寸铁、特别是妇女、儿童进行殴打，这是党纪国法不能容忍的。

5月1日，中共海口市委作出问责决定：中共秀英区委副书记、区人民政府区长、琼华村拆违行动总指挥黄鸿儒，疏于管理监督，对拆违行动组织领导不力，对行动风险评判不够，对干部教育管理不到位，导致发生重大事件，负有重要领导责任。根据《关于实行党政领导干部问责的暂行规定》第五条第三款、第七条和《海南省“庸懒散奢贪”行为问责办法（试行）》第五条第四款、第六条规定，海口市委同意黄鸿儒引咎辞去秀英区区长职务，同时免去其秀英区委副书记、常委、委员职务。

此外，包括中共秀英区长流镇委副书记、镇长张光学、秀英区联防大队大队长王彬等人也被问责。

引咎辞职在法律上有规可循

在这一起问责事件中，值得关注的是秀英区区长黄鸿儒引咎辞职。实际上，官员引咎辞职的案例在国内并不多见。之前，在2008年，时任国家质检总局局长李长江因为“三鹿”奶粉事件而引咎辞职。在什么情况下官员才会引咎辞职？

根据2009年6月印发的《关于实行党政领导干部问责的暂行规定》，对党政领导干部实行问责的方式分为：责令公开道歉、停职检查、引咎辞职、责令辞职、免职，该《规定》明确了问责的情况，包括对群体性、突发性事件处理失当等等，但并没有明确哪一种情况适合于引咎辞职这一问责方式。

不过，《公务员法》第十三章第八十二条规定：“担任领导职务的公务员，因工作严重失误、失职造成重大损失或者恶劣社会影响的，或者对重大事故负有领导责任的，应当引咎辞去领导职务。领导成员应当引咎辞职或者因其他原因不再适合担任现任领导职务，本人不提出辞职的，应当责令其辞去领导职务。”《党政领导干部选拔任用工作条例》也规定，“党政领导干部因工作严重失误、失职造成重大损失或者恶劣影响，或者对重大事故负有重要领导责任，不宜再担任现职，由本人主动提出辞去现任领导职务”。

综合来看，引咎辞职属于主动辞职，因工作严重失误等问题发生之后，首先应该是引咎辞职，如果不主动辞职，才会导致责令辞职或免职的问责。应该说，黄鸿儒的做法符合相关问责条款。

发生重大疫苗事故相关官员应引咎辞职

虽然上述对于引咎辞职的规定并没有列出更为具体的事项，但根据不久前国务院新修改的《疫苗流通和预防接种管理条例》，增加了地方政府以及监管部门主要负责人应当引咎辞职的规定。这也就意味着，假如在属地内发生重大疫苗事故，威胁到老百姓的健康安全，相关负责人就应该主动引咎辞职。
