三亚大东海夺命海滩:三年溺亡数十人

编者按：大东海，在很多游客印象中，是一个理所当然可以下海的地方。然而事实并非如此。

海滩上每隔几十米便立有一个写有“此处危险，严禁下海”的警示牌。

在三亚，大东海是唯一被承包给企业的海滩，但对于频发的溺水事故，该公司此前从未承担责任。

一个著名的旅游景区，在各方高度重视之下，为何依然频频发生溺亡事故？
一家民营企业，为何能在公共海滩充当“带有政府职能”的角色？

长约两公里的三亚大东海，蓝天白云，碧海银沙，比基尼美女。不过，最近一段时间，这个国家4A级景区却被紧张的气氛笼罩：两台沙滩巡逻车鸣着警笛来回穿梭，数名皮肤黝黑的救生员不时吹起哨子，个别不听话的游客被工作人员从海里揪上岸……
这源于半年多前发生的“8·15”溺水事故，被媒体重提。2015年8月15日，三个成都游客在距离海岸线仅十几米的海滩上溺亡。这是大东海史上最严重的一起溺水事故。
中国青年报·中青在线2016年4月1日刊发的上述报道，还披露了由死者家属搜集的一组不完全数据：近三年来，大东海溺亡人数达28人。
为此，家属以存在管理过失，对大东海经营管理有限公司（以下简称“大东海公司”）发起诉讼，这也是在大东海发生的溺亡事件中，第一次有家属诉诸法律。一审家属败诉，目前二审仍在进行中。
报道引起官方的高度重视，三亚市委书记张琦专门做出批示，要求加强大东海防溺水安全管理。然而，4月9日，又有一人在此溺亡。
4天之后，三亚市一名副市长带领有关部门人员在大东海召开了现场办公会。会上，大东海公司被要求“进一步强化防溺水主体责任的落实”，并被纳入市安全生产重点监管企业范围。
在三亚，大东海是唯一被承包给企业的海滩，但对于频发的溺水事故，该公司此前从未承担责任。
按照三亚市某政府部门一位官员刘名礼（化名）的说法，近年来，针对大东海溺水事故，三亚市政府和相关企业均投入大量资金和精力，仅他参加的相关会议就不下十几次，不存在“政府不作为”问题。但他承认，大东海溺亡事故多发态势并没有明显好转。
1“杀手”对于三亚本地人而言，大东海死人并不奇怪。
确切的死亡数字无从统计。据刘名礼透露，从上世纪90年代他来到三亚起，这里每年都会死人：最初是一年“两三个”；后来政府一度将大东海改为半封闭的收费景区，结果一年死“一两个”；景区再度开放之后，随着游客的增多，就变成一年“十几二十个”了。
在三亚，溺亡事故的一般处理流程是：死者亲属或事故发现者报案，警方介入调查排除他杀情况后，将怀疑有安全事故可能的转报给安监局。这意味着，安监局所掌握的溺亡数字，仅仅是全部溺亡者中的一部分。
南方周末记者查询发现，媒体对大东海溺亡现象的报道由来已久。早在2004年，《工人日报》就曾报道称，当年7月大东海就发生了6起游客溺水事故，共造成6人死亡。其中7月18日一天溺亡3人。报道因此质疑大东海成为“夺命海滩”。
2015年，大东海公司对外提供了一组救助溺水客人的数据：2012年464人，2013年372人，2014年296人，2015年（截至当年10月）162人。
溺亡者以外地游客居多（不乏外国人），不过按大东海公司救生队队长林军的说法，“本地人也多得是”。2012年6月18日，三亚市八一中学两名13岁的学生溺亡。
知名度最高的溺亡者，当属海南省临高县的牙医吕海鹰。2012年8月11日晚上，在参加同学聚会时，同学带来的两个小孩在戏水时被卷入海中，参与救人的吕海鹰不幸溺水身亡。
此事经媒体报道后，海南省委书记罗保铭作出批示，高度肯定了吕的救人行为。吕后来被评为见义勇为模范。
但鲜有人注意到，就在吕海鹰溺亡后的第二天，同样在大东海，又有两人死于溺水。
溺水事件多发生在每年的5月到9月之间，正值刮西南季风之时。从一份不完全统计名单上看，8月似乎是大东海最危险的月份。2012年8月，这里死亡4人，2013年8月死亡6人。
频发溺亡事故，与大东海复杂的地形和海况有关，比如看不见的暗流和深坑。另一个杀手是海浪。“浪一过来（有的游客）就慌神了，不慌神憋一口气或许就（被海浪）推回来了，一点事没有。”救生队长林军曾这样说。
按官方通报的口径，溺亡事故的主要责任多被归咎于游客自身。他们有的是在景区管理人员下班之后“擅自下海”，还有的是不服从景区管理“一意孤行”。
2015年“8·15”事故溺亡的3名成都游客，至少四家当地媒体给出了同样的理由：擅自翻越海边栏杆，在禁区海域游泳。
2“天天都是红旗”“这不是事实，”杨春梅说，“这种报道是对我们的二次伤害。”
她的丈夫易勇刚和外甥鞠易坤、孙童死于“8·15”事故。具体时间是当天下午五点半左右，距他们所乘的飞机抵达三亚尚不足5小时。
这趟旅行由易勇刚组织，为的是庆祝外甥们学业有成。共有7人：除了易和母亲、妻子、女儿之外，还有在四川省内某大学读大二的外甥鞠易坤（19岁），刚考上中国海洋大学的外甥孙童（18岁），刚考上一所重点高中的外甥女李兰心。
和打三折的机票一样，酒店是通过某旅游网站订的，那里距离大东海的主入口之一大东海广场不到二百米。
杨春梅很早就听说过大东海，在她印象中，这是一个理所当然可以下海的地方。作为内地游客，他们正是冲这一点来的。
事实并非如此。
出事前约半小时，刚进入大东海景区之际，孙童不经意间用手机给鞠易坤拍了一段时长73秒的视频，这是他们生前留下的最后影像。
画面中，鞠易坤穿着宾馆的拖鞋，兴奋地从大东海广场走向海边。他显然忽略了路边的警示牌滚动播放的“慎重下海游泳”，直到听到广播里柔和的女声：“尊敬的各位游客，大东海景区海况复杂，为了您的人身安全。严禁下海游泳……”
两人之间的对话，在一定程度上解释了悲剧发生的原因。
孙：严禁下海游泳？
鞠：啥子？怎么可能？
孙：你——妈。
鞠：怎么可能严禁下海游泳？
孙：海况复杂？
鞠：最好不往里头游……哇，人好多，边边上（游）就行，浅一点。
2016年4月中下旬，南方周末记者数次来到大东海海滩，依然看到有大量的下海者，他们大都在离海岸线不远处，很难分得清是在戏水还是游泳。多数时候，巡回检查的救生员们并不干涉。
海滩上每隔几十米便立有一个写有“此处危险，严禁下海”的警示牌。景区入口处的救生站多数时间里都挂着红旗（只有两次是黄旗）。
根据大东海公司的管理制度和显示屏上的提示，红旗是“禁止下海”的信号，黄旗表示“下海危险”，只有绿旗表示“安全”。
一位在此常年游泳的女士说，这里“天天都是红旗”。一位救生员说，只有在冬天的时候才会挂出绿旗。
刘名礼告诉南方周末记者，如果每天都是红旗，那就是大东海公司想掩饰责任。
杨春梅的代理律师程绍鹏认为，因为没有进行有效管理，所有的警示信息其实都沦为大东海公司逃避责任的挡箭牌。
3警示进入海滩之后，杨春梅一行选择了向左走（东侧）。后来的事情表明，这是一个致命的选择。
按照大东海公司总经理宋秀军的说法，他们在这个入口右侧（也就是西面）设立了六个专门的游泳区。在这些区域之外，都是不可以游泳的。
“我就不明白了，（你们）为什么到那里去？这么多的人都到泳区里（游泳），为什么要到不是泳区的地方？”在事后的一次沟通中，宋秀军曾这样责问家属。
“我们进去的时候根本就不知道！”杨春梅打断了他。按照她的说法，当时大海的东西两侧都有人，没有任何路标引导他们去“游泳区”。因为带着4岁的女儿，他们选择了游人相对少一些的西侧，不是去游泳，而是戏水。
宋秀军承认，景区没有对游泳区做出引导标识，因为这些区域是不固定的。但在他看来，这些游泳区域用浮球围起来，游客理应能识别，“否则围起来干吗？难道是养鱼的吗？”
南方周末记者多次在现场看到，在浮球所围区域之外，仍有大量的游泳者。多名受访者表示，他们并不知晓只有浮球所围的区域才是安全的。
沿海滩往东，前面四百余米处有一道铁制的栅栏。这是大东海景区与驻地单位理论上的分界线。按照刘名礼的说法，这个分界线已存在多年。2015年3月，驻地单位更新了栅栏，面向大东海竖了一个牌子，并写有“禁止游泳”的警示。
杨春梅说，当时正值傍晚，大海开始退潮。栅栏靠海的一端露出近二十米长的海滩，和许多游客一样，他们越过了栅栏，在不知不觉中进入了驻地单位区域。
出事之后大约一个月，吉阳区政府出资将原来的栅栏向大海方向延长了一段。南方周末记者日前在此处发现，由于新栅栏下面有个间隙，有的游泳者可以从下面轻松钻过去。
杨春梅说，出事地点在栅栏东侧约100米、距离海岸线约10余米的海域。
她这样描述当时的情形：易勇刚夫妇和女儿在沙滩上拍照，三个外甥（女）则渐渐远离。杨春梅预感到了危险，让易勇刚去将孩子们喊过来。
但是，就在半途中，杨春梅突然发现，两个男孩已经不见了，只剩下李兰心露着脑袋在那挥手乱划。易勇刚不会游泳。杨春梅看到，他一度曾拉住了李兰心，但是很快又分开，不久连他也不见了。
最近的一个救生站离出事地点约400米，值班人员发现了险情，并派人赶到。按杨春梅的说法，他们当时什么救生设备也没带，还是她向游客借了游泳圈，救生员才下海救人。
李兰心和易勇刚被救了上来。前者并无大碍，后者当时也有生命迹象——他把中午吃的饭吐出来了。杨春梅说，救生员给他做了一阵胸部按压，未做人工呼吸。120救护车随后来到，医务人员查看之后，宣布人已经没有了。
孙童和鞠易坤的尸体则分别于当晚和次日找到。
4“私有化管理”尽管大东海死人不足为奇，但一次溺死3人尚属首次。此事引起三亚市政府的高度重视，多家媒体在事发两天后刊发了报道。
杨春梅发现，先期报道的媒体几乎将全部责任都归咎于他们，对管理方的过失则只字未提。对于报道使用的“翻越栏杆”提法，她气愤不已：“我们还带着一个4岁的孩子，怎么可能翻越栏杆？”
刘名礼对这样的报道也感到不可思议，“那个护栏我很清楚，是翻不过去的，只能退潮的时候从一边走过去。”
孙童的母亲曾致电其中一写报道的记者，认为严重失实。
事发后第三天，在三亚市信访局的协调下，死者家属开始与大东海公司“谈判”。代表公司出面的宋秀军断然拒绝了家属的赔偿要求，明确表示在政府裁决之前，公司将“不负责”。
“这个景区毕竟是三亚市的景区，不是大东海自己的景区。”宋秀军说。
2001年，三亚市政府与刚刚注册成立的大东海公司签订合同，由后者承包大东海景区20年的“经营管理权”。
据当时《中华工商时报》的报道，被称为“肥肉”的大东海，20年经营管理权仅卖1800万元。当时三亚市政府采取了类似招标的方式选定承包人，但对企业的资质、经营水平几乎没有提出任何要求，只是要求出资最多者中标。而出资最多的老板又被政府官员“做工作”放弃，承包权由从未涉足旅游业的大东海公司现任董事长邢增平得到。
大东海公司在成立之后也屡出怪事。南方周末记者查询到的数份判决书显示，因为未经验资和未办理年检，这家公司一度被三亚市工商局拟吊销其营业执照。股东之间也纷争不断。大东海最初的多名股东已先后退出。前副董事长钟健还曾将公司告上法庭，并向公安机关举报公司董事长涉嫌犯罪。
2012年8月13日，南海网曾发表一篇报道，直言大东海频现溺亡是“海滩私有化管理之痛”。
就在8月30日，三亚市政府又与大东海公司重新签订合同，将后者对大东海的承包期由原来的20年延长到2052年。
合同中写明，大东海公司负责合同区范围内的海上安全救护，并对政府部门的执法工作提供资金物资支持。从2011年开始，大东海公司以每年151万元为基数，向三亚市政府上缴每年度的“政府旅游景区资源有偿使用费”。
就在这个月，大东海至少发生了四起溺亡事故，其中包括见义勇为模范吕海鹰。
据刘名礼介绍，在大东海这个公共海滩，大东海公司扮演了一个“为公众服务、带有政府职能的角色”。但它本身又没有执法权，对下海的游客无法强行禁止。
另外，在他看来，大东海是开放式的，公司并不从游泳中获利，因此在法律上很难让其承担游客溺亡的责任。
而杨春梅的代理律师程绍鹏认为，这背后有一层隐蔽的利益关系：大东海公司确实不直接从游泳中获利，但游泳是景区吸引外地游客的主要项目，并借此带动餐饮、游乐等其他消费。大东海公司正是靠向后者出租摊位赚钱。
“一旦真的禁止了游泳，游客人数下降，大东海公司的利益必然受损。”程绍鹏说。在三亚期间，他曾连续两天到现场观察发现：大东海公司一方面通过警示牌、广播等宣传禁止游泳，但对违规的下海游泳者却不实施有效管理。
5“意外事件”在家属与大东海公司就赔偿事宜的谈判和诉讼中，安监局对事件的定性成为关键。
南方周末记者了解到，针对“8·15”事件，三亚市安监局先后出过两份情况调查报告。第一份报告是应死者家属要求出具，仅描述事故发生过程；第二份报告对事件作了定性：“一起游客自行下海游泳导致死亡的非责任事故（或称意外事件）”。
刘名礼对南方周末记者说，大东海公司在三亚经营这么多年，如果定安全事故的话，安监局自身也将面临压力。
据刘名礼透露，在三亚，因客人在酒店游泳池溺亡引发的纠纷，安监局往往会定性为安全事故，让酒店作出赔偿以息事宁人。但是，对于发生在大东海这样的公共海滩上的溺亡事件，从来没有定性为安全生产事故的案例。
在后来的诉讼中，大东海公司将第二份报告作为证据，提交给了法院。
家属的代理律师程绍鹏无法认同这份报告。在他看来，所谓“意外事件”，是指事发纯属偶然、难以避免的溺亡事件，而大东海先前已屡屡发生溺亡事故，公司应该清楚存在安全隐患，并做到有效管理。因此，“8·15”事件理应定为安全生产事故。
2015年8月18日，在家属、大东海公司和三亚市信访局三方的沟通中，曾出现一个插曲：大东海公司派人送来安监局的定性报告，信访局邀请的一位律师看了之后，认为该报告恰恰说明，大东海公司自己承认出事地点是在其辖区内，这样的话公司也应当承担责任。大东海的代表对此无言以对。信访局一位副局长却提出异议，并很快将这份文件收起。
“他们想借我们的事情争管理权。”杨春梅这样理解大东海公司把一份对自己不利的材料交给信访局的用意。
“8·15”事件出事地点附近的栅栏分界线，大东海公司并不认可。
2015年5月，该公司向三亚市吉阳区委打了一份报告，称它原来的管理区域一直延伸到栅栏西侧300米处，请求区委尽快与驻地单位协调拆除栅栏，“还大东海4A旅游景区一个完整的沙滩”。
家属与大东海公司的谈判持续了5天，最后无果而终。杨春梅说，有清洁工和保安偷偷告诉他们，以前出事时也是这样，大东海从不赔钱，家属在信访局闹几天也就完了。
在与家属的一次沟通中，上述信访局副局长印证了这一说法。“不光你这个事”，“（就像）昨天我讲的，本地两个13岁小孩（溺亡）那个事，也是求人家（大东海公司）拿5万块钱，到现在也没协调下来。”
6“没有义务”2015年8月21日，是三名死者的“头七”，也是双方谈判的最后一天。在三亚市信访局的斡旋下，三亚市某法院一位法官被邀请来做调解工作。
法官建议，大东海公司垫付丧葬费，以后如果打官司，不够再要，多了可再退。但大东海总经理宋秀军当即拒绝，“如果这样的话我就不跟你协调；要走法律程序现在就走。”
双方最终走上了法庭。2015年11月20日，三亚市城郊人民法院对此案作出一审判决，驳回了原告所有诉讼请求。杨春梅随即提起上诉。
此案主要涉及侵权责任法第三十七条的适用：宾馆、商场、银行、车站、娱乐场所等公共场所的管理人或者群众性活动的组织者，未尽到安全保障义务，造成他人损害的，应当承担侵权责任。
一审法院的裁判理由是：溺水事故发生处并非在大东海管理区域范围；大东海是开放式景区，大东海公司无权制止游客自由出入，所以也没有义务派人在栅栏边的海滩处制止游客通过海滩。
在11月12日的一审庭审中，被告大东海公司纠正了前番曾将事故发生地视为其管理区的说法，强调事发区域不归公司管理，更不属于其划定的专门游泳的安全区域；只有在其专门划定的游泳区发生的溺水，才能算安全生产事故，公司也才负有责任。
原告则认为，死者是从大东海景区入口正常进入，出事海域与大东海是一个完整的景区，游客不可能知道被告与政府签订的合同所辖区域，被告也没有尽到提醒义务。
此外，原告还将自家的悲剧与大东海发生的其他溺亡事故关联起来，认为那些事故发生在驻地单位区域外，但也未定为安全生产事故，大东海公司同样也没有承担责任。
事发之后，为了应诉，杨春梅收集了近三年大东海发生的溺亡事故信息。其来源有两个：一个景区显示屏的溺亡案例，一个是媒体的公开报道，剔除重合的案例，共计28人。她认为，真实的溺亡人数应该更多。大东海公司对这个数字没有提出异议。
在这次庭审中，围绕公司是否曾劝阻游客不要进入驻地单位区域的问题，法官与代表大东海公司出庭的宋秀军曾有这样一段问答：
法官：他们一行人过围栏的时候，（你们）有没有人去阻止？
宋：如果他们说没有劝阻，我们这么多年在干什么？
法官：你直接回答，有就有，没有就没有。
宋：有。
法官：有人在那个地方值班吗？
宋：离那个地方有八十多米。
法官：你们是不允许游客往那个地方去是吗？
宋：那是禁区。
大东海公司代理律师：这不是我们的职责范围，我们没有权力阻止他们过去。
法官：我刚才问你有没有在那里阻止游客进入。你说有，现在你又说不是你们的职责……
最终，宋秀军承认，“我们没有人告诉他不允许进入”。
之后，大东海公司的律师向杨春梅发问：你有没有看到我们的警示牌？
“没有注意警示牌，”杨春梅提高声音说，“我只看到整片海都有人在游泳！”
