案件回顾

7月10日8时50分左右，黄某诚（男，现年35岁，琼海市潭门镇人）驾驶车牌号为琼A237V8的小轿车赶往琼海市人民医院看望入院治疗的妻子，因心情焦躁、情绪失控，一路超速行驶，在途经塔洋镇琼文东街时，不顾道路拥挤车流量大，强行从道路中间超车，造成多车相撞，一人死亡、一人受伤的重大道路交通事故。



事故发生后，在附近执勤的琼海市公安局塔洋派出所辅警符朝民等3人接到指示立即赶往事故现场维护秩序，符朝民到达现场后，帮助黄某诚解开安全带，将其从车内拉出来。黄某诚被拉出来后，不但不配合工作，还动手挥拳追打符朝民，后被制服。



经对黄某诚进行酒精含量和血液抽样测试，先后排除其酒驾、醉驾和毒驾嫌疑。经排查，也未发现黄某诚有吸毒史、精神病史。经司法鉴定：事故发生前，琼A237V8小型汽车虚拟基准线经过右前轮中心点至右后轮辋前边沿(两参照点)的行驶速度约为107km/h，大大超过事故路段30km/h的限速。

黄某诚的行为，已触犯了《中华人民共和国刑法》第一百一十五条之规定，涉嫌以危险方法危害公共安全罪，目前已被琼海市人民检察院批准逮捕。此外，黄某诚以暴力方法阻碍公安机关工作人员执法，涉嫌妨害公务罪，警方已向检方提交相关材料，案件正在进一步审理中。
